Uptime ("we," "our," or "us") operates the website https://www.getuptime.ai and the UpTime Driver mobile application (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.
Please read this Privacy Policy carefully. By using the Service, you agree to the collection and use of information in accordance with this policy.
1. Information We Collect
Personal Information You Provide
When you create an account, complete your profile, or use our services, we may collect:
- Name, email address, phone number, and mailing address
- Commercial Driver's License (CDL) information, endorsements, and driving history
- Employment history and job preferences
- Profile photos and uploaded documents (licenses, certifications)
- Company information (for fleet managers)
- Payment and billing information (processed securely via Stripe)
Information Collected Automatically
When you access or use the Service, we automatically collect:
- Device information (model, operating system, unique device identifiers)
- Log data (IP address, browser type, pages visited, timestamps)
- Location data (with your permission, for job matching based on proximity)
- Usage analytics via Firebase Analytics and Crashlytics
Camera and Media
With your permission, we access your camera and photo library to allow you to take or upload profile photos, license images, and other documents required for your driver profile.
AI Video Interview, Voice, and Face Data
The UpTime Driver mobile app offers an optional AI-powered video interview feature. Recording an interview is voluntary; you may use UpTime Driver and apply to jobs without recording one. With your explicit permission to access your microphone and camera, when you choose to record an interview we collect:
- Voice/audio: Your spoken responses during the interview are streamed in real time to our AI conversation provider, ElevenLabs, Inc., so the AI agent can understand you and respond conversationally.
- Video (including your face): Your device camera records video of you (including images of your face) for the duration of the interview. The video file is recorded locally on your device and uploaded directly to our own cloud storage (DigitalOcean Spaces). The video is not shared with ElevenLabs or any other third-party AI provider.
- Conversation transcript: ElevenLabs returns a transcript and the audio recording of the conversation, which we store on our own cloud storage alongside the merged interview video.
How face/video data is used: Recorded interview videos are used solely to help fleet managers and recruiters on the UpTime platform evaluate you as a driver candidate. We do not use facial-recognition, facial-feature analysis, biometric identification, emotion detection, or any other biometric-derived processing on your video. The video is not used to train AI models, is not sold, and is not shared with advertisers.
Who can see your interview: Your recorded interview is visible only to you and to fleet managers/recruiters on the UpTime platform whom you have applied to or been matched with as part of the job-matching process.
Retention and deletion of voice/face data: Your interview video, audio, and transcript are retained for as long as your account is active. You may delete your recorded interview at any time from the app, and you may permanently delete your entire account from within the UpTime Driver app (Profile menu → Delete Account), which will permanently remove your interview video, audio, transcript, profile, documents, and all associated personal data from our systems. Deletion requests are typically processed immediately and within 30 days at the latest.
Apple Face ID: If you choose to enable Face ID to authenticate into the app on supported devices, the Face ID authentication is performed entirely on your device by Apple. UpTime does not receive, store, or have access to your Face ID biometric data; Apple only returns a yes/no authentication result to the app.
2. How We Use Your Information
We use the information we collect to:
- Create and manage your account
- Match CDL drivers with fleet managers using AI-powered job matching
- Facilitate communication between drivers and fleet managers
- Process subscription payments and manage billing
- Send push notifications about job matches, messages, and account updates
- Provide location-based job recommendations
- Improve our Service through analytics and crash reporting
- Comply with legal obligations and enforce our terms
3. How We Share Your Information
We do not sell your personal information. We may share your information with:
Fleet Managers and Drivers: Your profile information is shared with potential employers or candidates as part of the job matching process.
Service Providers: We use third-party services including Stripe (payments), Firebase (analytics, notifications, crash reporting), DigitalOcean (cloud hosting and file storage), and ElevenLabs (conversational AI for the optional AI video interview feature) to operate our Service. ElevenLabs receives only your spoken audio from the interview session for the purpose of generating the AI conversation and returning a transcript; ElevenLabs does not receive your video, your profile, your documents, or any other personal information.
Legal Requirements: We may disclose information if required by law, regulation, or legal process.
Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred.
4. Data Security
We implement appropriate technical and organizational measures to protect your personal information, including encryption of data in transit and at rest, secure authentication, and regular security assessments. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
5. Data Retention and Account Deletion
We retain your personal information for as long as your account is active or as needed to provide you with our services.
You may permanently delete your account at any time directly from within the UpTime Driver mobile app by tapping the profile icon in the header, then selecting Delete Account and confirming the request. Deleting your account will permanently remove your profile, uploaded documents, recorded AI video interview, interview audio and transcript, push-notification tokens, messages, and all other personal data associated with your account from our systems. You may also request deletion by contacting us at support@getuptime.ai. We may retain a minimal record of the deletion event and certain anonymized data as required by law or for legitimate business purposes.
6. Your Rights
Depending on your location, you may have the following rights regarding your personal information:
- Access, correct, or delete your personal data
- Opt out of marketing communications
- Withdraw consent for location tracking or push notifications through your device settings
- Request a copy of your data in a portable format
- Lodge a complaint with a data protection authority
7. Third-Party Services
Our Service integrates with third-party services that have their own privacy policies:
- Google Firebase: Analytics, crash reporting, and push notifications
- Stripe: Payment processing
- Google Maps: Location services
- DigitalOcean Spaces: Cloud storage for profile photos, uploaded documents, and recorded AI interview videos

8. Children's Privacy
Our Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child without parental consent, we will take steps to delete that information.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated policy.
10. Information Collected via Meta (Facebook) Lead Ads
We may collect personal information through lead generation forms on Meta platforms, including Facebook and Instagram.
When you submit your information through these forms, we may collect details such as your name, phone number, email address, location, and other relevant information you choose to provide.
We use this information to:
- Contact you regarding driver recruitment opportunities
- Provide information about our services and job matches
- Follow up on your interest in working with Uptime
By submitting your information through Meta lead forms, you acknowledge and consent to being contacted by Uptime via phone, SMS, and email based on the details you provide.
You may opt out of these communications at any time.
Your information collected through Meta lead ads is handled in accordance with this Privacy Policy. We do not sell your personal information and take appropriate measures to protect your data.
